Domicile certificate mandatory in Maharashtra

Domicile certificate is a key document that enables its holder to prove that he/she is a resident of the state, which has issued the certificate, either by birth or for a period in excess of 15 years in case of Maharashtra. The document enables the holder to avail of the domicile/resident quotas extended by the concerned state in education and jobs, among other things. The district collectors are the issuing authority for domicile certificates.
The latest notification, however, clarifies that a domicile certificate won’t be required in the case where a student has cleared Std XII as well as Std X from the state. However, “students, who are not residents of the state, won’t be eligible for the health science courses even if they have passed their Std XII from Maharashtra.”
On Friday, the state government released a notification specifying details of distribution of the MHT-CET application forms, besides the eligibility norms and allied matters.
The mandatory domicile provision for students, having done their SSC from outside Maharashtra, was introduced last year, primarily to curb the outside students from cornering a bigger share of professional seats at the expense of the students from Maharashtra.
For engineering and pharmacy courses though, the outside Maharashtra state (OMS) students will be permitted to appear for the MHT-CET to attain eligibility of admission to the first-year degree courses. However, the eligible OMS candidates for engineering courses will be considered for admission against the institute-level seats only at private unaided colleges. Similarly, OMS candidates for pharmacy courses will be considered for admission to the 15 per cent OMS quota through the round I and II of the centralised admission process, to be conducted by the state director of technical education, the notification states.
The move drew widespread protests from students, not meeting the domicile norm, and even prompted a PIL in the Nagpur bench of the Bombay high court, following which the department of higher and technical education agreed to relax the norm for engineering courses.
Medical degree course aspirants, who may have passed Std XII from Maharashtra but Std X from outside the state, will have to furnish a domicile certificate to be able to appear for the ‘MHT-CET 2011′, the combined entrance exam for health sciences, engineering and pharmacy courses, scheduled for May 12.
Similarly, students who clear their Std XII from outside Maharashtra, won’t be eligible for the health science courses irrespective of their domicile status as a citizen of the state, the notification states. The government has made exceptions to this clause in the form of the defence candidates; students from the Maharashtra-Karnataka Border Area; children of employees of the central, state and Union territories governments.
Meanwhile, the MHT-CET 2011 application forms will be distributed from March 23 to 31 through the respective high schools and junior colleges. The government has also assigned divisional authorities to enable the OMS candidates secure the application forms by submitting a demand draft of Rs 700 in favour of the ‘Competent Authority, MH-CET, Mumbai’ payable at Mumbai and drawn on any scheduled commercial bank.

Now those who want to pursue health sciences courses but have not cleared their standard XII exam from the state will have to submit domicile certificate in order to become eligible for Maharashtra Health and Technology Common Entrance Examination (MHT-CET) from this year onwards.

A Domicile/Residence Certificate is generally issued to prove that the person bearing the Certificate is a Domicile/Resident of the State/UT by which the Certificate is being issued. This Certificate is required as proof of residence to avail Domicile/Resident Quotas in educational institutions and in the Government Service, as also in case of jobs where local residents are preferred.
The prescribed application forms are either available online or from the local authorities, i.e., the Sub-Divisional Magistrate/Tehsildar’s office/Revenue Department/District Collector’s Office, or any other authority as specified in the State/UT of your residence. You will be required to produce proof of continuous residence in the State/UT for a specified minimum period, or that of holding land in the State/UT, depending on the rules in the State/UT concerned. Documents for proving your identity, attestation of the form by officers with the necessary authority, school certificates and the Tehsil Enquiry Report may also be required.
Women not originally belonging to a State/UT, but married to men who are permanent residents of the State/UT or who are eligible for the State’s/UT’s Domicile Certificate, are eligible to apply for Domicile Certificate.
Note:
Domicile Certificate can be made only in one State/UT. Obtaining Domicile Certificate from more than one State/UT is an offence

My daughter has been studying in Navi Mumbai ( Maharashtra ) since class 5th ( 2003)- including X and XII exams. As per your main article the Domacile is not required if X and XII is passed in state.

4.7 Exception for SSC (10th) and HSC (12th) or equivalent examinations: Children of employees of the Government of Maharashtra or its Undertaking :- Children of employees of the Government of Maharashtra or its Undertaking posted on deputation or transfer to a place outside the State of Maharashtra, or transferred from outside to a place situated within
the State of Maharashtra:-
1. The children of such employees of Government of Maharashtra or its undertaking who have joined service since beginning at a place situated outside the State of Maharashtra but who have been transferred to a place situated within the State of Maharashtra shall be eligible for admission even though such children might have passed the S.S.C.(Std. X) and/or H.S.C. (Std.XII) or equivalent exam from the recognized Institutions situated outside the State of Maharashtra, provided that such an employee of Government of Maharashtra or its Undertaking must have been posted/ transferred/ deputed at a place of work located in the State of Maharashtra and also must have reported-for-duty i.e. joined the duty before the last date of submission of Preference Form.
2. The candidates belonging to the aforesaid category at (1) shall be required to produce the requisite Certificate from the Office at which such an employee of Government of Maharashtra or its Undertaking has reported for duty as a proof that such employee has joined the office and/or reported for duty before the cut off date for eligibility i.e. the last date of submission of Preference Form. The certificate should contain full name of the employee, designation, transfer/posting order number and date, date of joining and present status of posting. A copy of transfer/posting order should also be produced at the time of filling the preference form.
3. The children of such employees of Government of Maharashtra or its Undertaking who have been transferred or deputed to a place situated outside the State of Maharashtra or who have returned to the State of Maharashtra after initial transfer/deputation shall be eligible for admission even though such children might have passed the S.S.C. (Std. X) and/or H.S.C. (Std. XII) or equivalent examinations from the recognized Institutions situated outside the
State of Maharashtra.
4. The candidates belonging to the aforesaid category at (3) above shall be required to produce the requisite Certificate from the Office at which such an employee of Government of Maharashtra or its Undertaking has reported for duty. The certificate should contain full name of the employee, designation, transfer order number and date, date of joining and present status of posting. A copy of transfer order should also be produced at the time of filling the preference form.

Which notification you are mentioning, the CET brochure i have down loaded, which clearly mention about Type-A category, where in you should complete SSC and HSC from Maharastra and you should be domicile of Maharastra. The documents required to submit are bonafide certificate from college and domicile certificate. This category of Type A is very clear of requirement of Maharastra Domoicile.
The notification i mentioned above is for health science courses.
For MBA one of the applicant confirmed the domicile is required.
For engineering you can refer the brochure.
I had a domicile made two years ago . Is this domicile valid for application to MHT CET examination which i wish to give in 2012 ?
Domicile Certificate is normally valid for 12 months and is subject to review by the Revenue authorities.
In some States like Haryana, it is prepared for 5 years.
Better enquire from local Executive Magistrate office.
They may accept it as document check is linient in most of the cases.But as you have time you can apply for new one.
The state government’s relaxation of the domicile certificate requirement for admissions to professional courses has been widely welcomed, but it has nevertheless left candidates lined up for management courses confused.
The relaxation order came on Monday, well after the start of the admission process for management courses. So, students who having failed to procure domicile certificates filled their forms in the outside Maharashtra state (OMS) category are not sure of how their forms would now be sorted out.
A parent said: “Several students were told to fill the forms as OMS candidates when they could not procure domicile certificates. Monday’s directive does not say what happens to these students. My son scored 98% in the entrance test.
But he was forced to fill the form as an outside student. How does the directorate of technical education (DTE) plan to sort out these forms?”
The relaxation means that a student born in the state can secure admission by producing only a birth certificate. But a student who has lived in Maharashtra for more than 10 years but was not born here still needs to submit a domicile certificate.
A student who has applied in the OMS category said: “I was not born in Maharashtra but have stayed here for more than 15 years. Students like me still have to procure domicile certificates . In any case, the state should have given the relaxation much earlier. Tehsildar offices (which issue the certificates) would have been able to process the applications faster had there been fewer of them.”
S K Mahajan, director in charge, DTE, said: “Not more than 1,100 candidates were unable to submit the required documents. (Giving such candidates more time) we extended the dates of form submission by a week.”
The relaxation came after the government realized that procuring domicile certificates was tedious and time-consuming for students. Also, it was becoming difficult for the revenue department (under which tehsildar offices come) to process the glut of applications . The new rule is that for a student who has neither a domicile nor a birth certificate, the school-leaving certificate should mention the place of birth as one within Maharashtra. Students failing to satisfy this norm would need to apply under the OMS category.

I am working in Airports Authority of India,(a Govt. of India Undertaking)for last 23 years. It is a transferable job and I had been transferred from Portblair Airport to Mumbai Airport in the year 2000. Since then i am staying in Mumbai and purchased flat at Kalyan in 2001. My son had passed Xth and XIIth standard from Maharashtra and currently doing his BE(Elex), 4rd year from Pune University. Till date i did not require to produce domicile certificate. Now, after completion of my son’s Engineering Course, he is interested to pursue MBA. My doubt is, 1) whether Domicile Certificate will be required for him during admission? 2)Whether he will be able to get Domicile Certificate? 3) Is there any relaxation of number of years of stay in Maharashtra for Central Govt. If one has cleared ssc(10th) and hsc(12th) both exams from Maharashtra then he/she is eligible to attend test without domicile certificate.

Nandita if your son have birth certificate of Mumbai then it would be very easy. otherwise he can appear as Outside Maharashtra State (OMS) candidate.

I am an employee of one of the largest Corporate Indian IT Companies on deputation in Middle East for last 4 years on project. I am born in Mumbai, wife from Aurangabad and our son is born in Maharashtra. I and my wife are domiciled in maharashtra and my son has studied till 8th standard in Mumbai.. So in short he has also stayed more than 10 years in mumbai. So he is also eligible for domicile in mumbai. He has done his Xth and doing XIIth from CBSE in Middle east.

We have been in Maharashtra only since 2007. My daughter is now in class XII and will be appearing in class XII – ISC exam next year ie 2013. Is it true that not having been born in nor residing in Maharashtra for over 15 yrs, she will not be having domicile of Maharashtra and hence can not apply for admission in any Govt / Govt aided college in Maharashtra through CET ? What are her options then ? I believe , in non-aided colleges the fees might be too high. Is that true ?

My son is born in mumbai. studied in mumbai and he has appeared for the HSC exam. It is understood that no proof of domicle is needed for MHCET. BUt what about the courses outside the State of Maharashtra. They are asking for the Domicile Certificate. So in effect, a child needs a domicile certificate. What i would like to know is whether to get a domicile for my son who is in mumbai since birth, should the father also have a domicile certificate of that state.
Is the domicile certificate necessary for B.com course as well?
